Understanding the Term Reversed and Remanded in Oklahoma Criminal Law

When you hear the term reversed aand remanded in criminal law it means that the lower court's decision was overturned and the case was returned to the lower court. Most successful appeals result in the appellate court reversing the conviction and remanding the case back to the trial court for a new trial. The goal of every appeal is to get the appellate court to rule there was reversible error in th elower courts.

Reversal By the Appellate Court

Reversal generally does not mean the case is resolved, it generally just means the defendant will have an opportunity at trial. If there is a legal reason the case can not be presented to a jury after it is reversed on appeal the appellate court will reverse the conviction with instructions to dismiss.
