Section 641) Battery is defeinded in Oklahoma as "A battery is any willful and unlawful use of force or violence upon the person of another." (See Title 21 O.S. Section 642) The Oklahoma statute that covers punishmnet for simple assault and assault and battery can be found at Title 21 O.S. Section 644.

Aggravated Assault and Battery

Aggravated assault and battery is a felony in the state of Oklahoma carrying up to 5 years in prison. Aggravated assault and battery is a non-eight-five perecent offense, meaning an individual convicted of aggravated assault and battery and sentenced to prison is not required to serve eight-five perecent before being released form prison.

In Oklahoma an assault can be an aggravated assault if "great bodily injury is inflicted upon the person assaulted" or the person committing the assault is of "robust health or strength" and the person assaulted is "aged, decrepit or incapacitated". (See Title 21 O.S. Section 646)

Assualt and Battery with a Dangerous Weapon

Assault and battery with a dangerous weapon is defeined as an assault upon another with any sharp and dangerous weapon with the intent to injury that or any other person, but without the intent to kill that person. The punishment for assault and battery with a dangerous weapon is up to 10 years in prison. (See Title 21 O.S. Section 645)
