It is customary for criminal charges to be brought by the prosecutor governmental agency. In Oklahoma there is a statute that requires that criminal charges be brought in the name of the state of Oklahoma against the person who is accused.

"A criminal action is prosecuted in the name of the State of Oklahoma as a party, against the person charged with the offense". (See Title 22 O.S. Section 11)
