A good private investigator can be the difference between winning and loosing a criminal case. While private investigators are not necessary in all criminal cases, in some cases they are essential. Far too often law enforcement will only collect evidence that supports the charges they are making against a defendant; if law enforcement collects evidence favorable to a defendant the prosecuting agency is legally obligted to turn that evidence over to the defense. (See Brady v. Maryland, 373 U.S. 83 (1963)) As a result of the obligation to disclose favorable evidence to the defense, some officers intentially do not collect evidence that is favorable to the defense.
Other officers may not collect evidence that is favorable to the defense because they can only see the case through from the law enforcement's point of view or the officers may not know of the existence of evidence that undercuts the case against a defendant.
