Oklahoma Criminal Lawyer Explains Actual Physical Control (APC) in Oklahoma

Actual Physical Control or APC refers is one way to violate Oklahoma's DUI statute. In Oklahoma you do not actually have to be driving to get arrested for Actual Physical Control of a vehicle while intoxicated. The term "Actual Physical Control" comes straight out of Oklahoma's DUI law found at Oklahoma Statute Title 47 Section 11-902.This is a controversial statute in the sense that if a person realizes they are too intoxicated to drive and they pull over to sleep it off that they are subject to the same punishment as if they were caught driving by law enforcement while intoxicated. Many people believe that the law should encourage drivers that may have had too much to drink to pull over until they are safe to drive and that the law should offer some incentive for drivers to do so.
